Definition Zoning Clause 5.3.4 'Notwithstanding the provisions of the Residential Design Codes, where land with a residential density code of R40 is located outside the area of a walkable catchment of 800 metres around an activity centre, specialised centre or railway station on a high frequency rail route as shown on the Scheme Maps or as shown on a map contained in a schedule of the Scheme, the development of multiple dwellings on the land: (a) shall be subject to the average site area per grouped dwelling requirement specified by the Residential Design Codes for grouped dwellings on land with an R40 residential density code; and (b) shall not be subject to any maximum plot ratio requirements specified by the Residential Design Codes.'
Will this mean I can’t develop multiple dwellings on my lot? The amendment will only change the way multiple dwelling yield is calculated within certain areas of the City. Multiple dwellings can still be approved within residential R40 areas, however in areas subject to clause 5.3.4 of the Local Planning Scheme, the multiple dwelling yield is based on the R40 group dwelling average site area rather than the plot ratio standards as stated in the R-Codes.
